Vacationland News – Advertising Terms and Conditions
These terms and conditions govern all orders for print, digital and preprint advertising placements fulfilled by be smart communications through the Vacationland News.
1. Advertising Media
The Client shall be responsible for providing ad material necessary to meet publication deadlines – including all artwork and/or digital files in adequate format and quality for print and digital publication.
Changes to existing ads can be made each issue and should be submitted by Sunday, prior to the Wednesday publication. If significant adjustments are required, 7 days prior to the publication date is needed to ensure adequate time for development and proofing.
2. Ad Preparation
On request, be smart communications may assist in preparing ad designs for publication. This assistance may include layout, composition, copy, and artwork. be smart communications retains all rights, including copyright, to designs that represent the creative effort or contain newly created material. Ad development fees may be applicable, and will be communicated and agreed upon prior to commencement of any design work. The client retains ownership of all provided material and remains solely responsible for the contents of the ad and for compliance with any laws regulating such advertising.
3. Warranties & Indemnity
Where the Client provides materials (including all Intellectual Property Rights to all elements of text, graphics, photos, designs, trademarks, or other artwork in the course of the project), the client guarantees ownership or permission to use them. The client grants be smart communications a royalty-free license to use or alter provided materials under the scope of this project and to use representations of the designs in a printed and/or digital portfolio (as a sample of past works) in trade publications, educational material, promotional material, and/or social media.
The Client is solely responsible for any legal liability arising out of or relating to the ad, and/or such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any anti-discrimination law or regulation, or any other right of any person or entity. The Client agrees to indemnify be smart communications and to hold them harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by the be smart communications, arising out of or related to the Client’s breach of any of the foregoing.
be smart communications will take great care to ensure the client is represented by high-quality printing standards, however, no warranties or guarantees are made in the reproduction quality or accuracy of submitted elements.
In the event of errors or omissions attributable to be smart communications, including but not limited to typographical errors, inaccuracies, or incorrect placement, be smart communications agrees to provide credit to the Client for a future issue equivalent to the cost of the advertising space affected by the error.
It is the responsibility of the Client to thoroughly proofread and approve all ad materials before the specified deadlines. If errors occur due to the Client’s failure to provide accurate and error-free ad materials, or if adjustments are required after the specified deadlines, no credit will be provided.
Additionally, be smart communications shall not be held responsible for errors arising from technical issues, data corruption, or any other factors beyond its control.
4. Fees
Payment for advertising in the Vacationland News is due in full upon receipt of invoice unless otherwise set out in the Client’s payment terms. The invoice will be emailed to the Client and the cost will reflect the size and specifications of the ad space and term requested. Cheque, electronic funds transfer, Visa, or MasterCard are accepted. A service charge of 3% per month will be added to any invoice not paid within 30 days of billing.
Payment received for terms of advertising are non-refundable. In the event that a client wishes to terminate their advertising term before its completion, the client agrees to fulfill the payment obligation for the entire agreed-upon term.
5. Advertising Period
The Client and be smart communications hereby agree that the Client’s ad will be displayed in the Vacationland News for the period of time identified on the invoice. In the event of a material change to the terms and conditions, be smart communications will notify Clients in writing.
6. Right to Refuse
be smart communications will not accept advertising that it determines, in its sole discretion, will reflect poorly upon be smart communications, other clients, its readers and/or the long term use of this advertising space.
7. Force Majeure

8. Ad Usage
The Client understands that an original ad design created by be smart communications shall not be reproduced, replicated or used for any other purpose without prior written approval.
9. Proof of Publication
All issues of Vacationland News, including those containing the Client’s advertisement, will be made available on the website vacationlandnews.com on the date of issue.
